Indemnity Form

Tauranga Archery Club Incorporated (trading as “Tauranga Archers”)

This form applies to all Club activities including (but not limited to) club days, coaching, events, have‑a‑go sessions, trial shooting, the indoor range and general grounds use.

For the purposes of this document, ‘participant’ includes any person attending or assisting with Club activities in any capacity, including spectators, helpers, and volunteers, unless expressly stated otherwise.

1. Acknowledgement of Risk

I acknowledge that participation in archery activities involves inherent risks, including the risk of serious injury, permanent disability, death, and property loss. These risks may arise from, but are not limited to:

• the use of bows, arrows, targets, and related equipment;
• terrain and facilities;
• weather and environmental conditions;
• physical exertion and fatigue;
• actions or omissions of other participants, members, volunteers, or officials.

I voluntarily choose to participate with full knowledge and acceptance of these risks.

2. Fitness to Participate

I declare that:

• I am physically and medically fit to participate in archery activities;
• I have not been advised by a qualified medical professional to refrain from participation;
• I will immediately stop participating and notify a Club official if I believe participation may be unsafe.

3. Compliance with Club Rules

I agree to comply at all times with:

• the Tauranga Archery Club Rules and Range Rules;
• all safety procedures and instructions;
• all lawful directions given by appointed Range Officers, coaches, instructors, and authorised Club officials.

I understand that failure to comply may result in removal from activities or disciplinary action in accordance with the Club’s Constitution.

4. Release and Indemnity (Non‑Personal Injury)

To the maximum extent permitted by New Zealand law, I agree that Tauranga Archery Club Incorporated, its officers, members, volunteers, representatives, and agents will not be liable for loss of or damage to my personal property, or for claims arising from my own acts or omissions while participating in Club activities.

I agree to indemnify and hold harmless Tauranga Archery Club Incorporated against claims made by third parties resulting directly from my negligent or reckless conduct while participating.

5. Accident Compensation Act 2001 (New Zealand)

I understand and acknowledge that:

• Personal injury suffered in New Zealand is generally covered by the Accident Compensation Act 2001 (ACC);
• Nothing in this waiver is intended to exclude, limit, or modify any rights I may have under the Accident Compensation Act 2001;
• This waiver does not limit any rights where such limitation is prohibited by law.

6. Medical Consent

In the event of injury, illness, or emergency, I consent to receiving any medical treatment deemed necessary by qualified medical personnel and accept responsibility for any associated costs to the extent they are not covered by ACC or insurance

7. Photography and Media

I consent to photographs, video, or other media recordings taken during Club activities being used by Tauranga Archery Club Incorporated for legitimate Club purposes, including promotion and reporting.

8. Minors (Participants under 18 years of age)

Where the participant is under 18 years of age, the parent or legal guardian:

• confirms that they have read and understood this document;
• consents to the minor’s participation in Tauranga Archery Club activities;
• acknowledges that participation is subject to Club Rules and supervision requirements;
• accepts responsibility for ensuring the minor complies with Club Rules and safety directions.

9. Declaration

I confirm that:

• I have read and understood this Accident Waiver and Risk Acknowledgement;
• I understand that this document is legally binding to the extent permitted by law;
• I understand that my consent may be recorded electronically and that electronic consent is valid and binding;
• I am signing this document freely and voluntarily.
